POSITION STATEMENT

 

 

SUBJECT: Complaint Notification Policy

 

 

 

The West Virginia Board of Occupational Therapy has a position for a Certified Investigator/Inspector to investigate formal and anonymous written complaints made against any licensee or body providing OT within the state and to conduct spot checks pertaining to licensure issues at facilities/business’s within the state.

 

The Board has taken the position that when a formal written complaint has been received against a  licensee that individual will receive a copy of same complaint.

 

Upon consulting with the Attorney General’s office, there are no laws stating that a licensee or facility must have prior notification of an investigation being conducted. This Board’s position is that prior notification will not be given to a licensee or facility being formally investigated in order to protect the validity of the results of the investigation.

 

The Board will notify all persons that are investigated at the end of such investigation of the findings.
