During the 2020 Legislative Session, House Bill 4003, requiring healthcare Boards to regulate telehealth practice, was passed.  Below is a link to the proposed Rule to establish procedures for the practice of telehealth by an occupational therapist or occupational therapy assistant.  The Rule will be open for public comment through August 1, 2020.  Please submit written comments to help@wvbot.org or through Contact Us on the homepage of this website.

Also available for comment is a modification to Legislative Rule §13-2, Disciplinary, Complaint and Contested Case Hearing Procedures for Occupational Therapists and Occupational Therapy Assistants.  The modification removes the sixty day requirement in §13-2-5.9 to review and investigate complaints.  W.Va. Code §30-1-5(c) requires boards to send a status report to the party filing the complaint and the respondent within six months of receipt, and issue a final ruling within one year of the status report.  Written comments may be emailed to help@wvbot.org or through Contact Us on the homepage of this website.
