During the 2020 Legislative Session, House Bill 4003, requiring healthcare Boards to regulate telehealth practice, was passed. Below is a link to the proposed Rule to establish procedures for the practice of telehealth by an occupational therapist or occupational therapy assistant. Also available for comment is a modification to Legislative Rule §13-2, Disciplinary, Complaint and Contested Case Hearing Procedures for Occupational Therapists and Occupational Therapy Assistants. The modification removes the sixty day requirement in §13-2-5.9 to review and investigate complaints. W.Va. Code §30-1-5(c) requires boards to send a status report to the party filing the complaint and the respondent within six months of receipt, and issue a final ruling within one year of the status report.
